On 27 July 2007 Ghulam Shabbir Magistrate granted bail to two accused, booked under Section 324 and 337 F PPC on grounds that in FIR they were not ascribed role of causing any hurt to the victim and that Investigating Officer had declared them innocent that rendered the case ‘of further inquiry’. However, during hearing of the application, a certain number of lawyers exerted pressure on the court for rejecting the bail petition but the court repelled their pressure and granted bail to petitioners according to principles of criminal jurisprudence and administration of justice. The victim happened to be an advocate who was allegedly injured by his co-villagers due to old enmity.
On 28 July 2007 the lawyers turned angry over the bail order and stormed the courts. They shouted slogans and used bad mouthing against District Sessions Judge and the Magistrate. They broke name plate of the magistrate and locked the court room. Instead of following legal course for rejection of bail, they announced boycott of the courts without any resolution passed in bar association’s general body meeting. They vowed to continue boycott till their demands were met. Next day the District Sessions Judge was constrained to hold negotiations with leaders of advocates to cool down the situation. During the meeting advocates placed three demands for calling of boycott. The demands were as follow:-
1. The court should recall the bail order.
2. Magistrate is posted out.
3. Accused in the case still at large should be arrested immediately.
The Sessions Judge accepted all the above demands. News of the deal was published in print media. Local FM Radio Station also broadcast this news.
A few days latter two lawyers were caught red handed while stealing electricity. Separate cases against them were registered in Police Station Kuthala Sheikhan vide FIR No. 430 and 431 under section 39-A Electricity Act. The lawyers with their influence and pressure got the cases cancelled. On 29 Aug 2007 another case was registered in Police Station Sadar Mandi Bahauddin against one more member of the bar association for torturing and beating a rickshaw driver and belaboring shop keepers with physical beating who tried to disengage parties scuffling with each other. Next day i.e. on 30 Aug lawyers held meeting and demanded cancellation of case registered against their colleague with in three days failing which stringent course of action would be followed for pressurizing police to cancel the case. Boycott of courts was also observed; lawyers’ main modus operandi to develop pressure on government functionaries.
On the other side the District Sessions Judge and the Magistrate have received posting order prematurely.
Is this type of justice and independence of judiciary lawyers want to restore? PESS Mandi Bahauddin and its large number of members believe that conduct and illegal activities of lawyers are prejudice to smooth and transparent administration of justice. Therefore, in the interest of general public and for the sake of quick dispensation of justice, concerned authorities including Punjab Bar Council Lahore are called upon to take notice of the above unlawful incidences of moral turpitude on the part of lawyers and take proper action against the culprits. No one should be considered above law of the land.

Sir, I find your feelings are full of love for Pakistan and its people. And one react against those from whom you have expectations. With that premise I expect something which must be according to law and justice. Lawyers responsibility and duty is to help people to get justice. And once they, themselves violate law, how one can expect help in the administration of justice from them. Sir, I have another complaint agaist their conduct. Ant hat is that they observed 6 Sep as black day. This day has significant importance in the history. On this day our armed forces fought against Indian army, three times more in number and resources, and spoiled its aggresseve disigns to concour Lahore and Silakot. In performance of this sacred mission, thousands soldiers laid down their live in defence of the copuntry. We owe them gratitude. Our martoyers call opun us to celebrate this day woth solemnity and traditional zeal. Let me say it frankly lawyers deliberately ignored sacrifices given by soldiers of our armed officers and choose this sacred day for launching movement in the name of 'to preserve the rule of law, supermecy of the constitution and to end army rule' with hoisting black flags on bar rooms, wearing black bandages on arms abd observining boycott of the courts. This is malafides of the lawyers which every pakistani must condemn. As regards their onjects of the movement, every government coming into power claim them to achieve. 05-09-2007 11:02, IP 124.29.214.225, Registered Mr. Major, i would like to draw your kind attention to the fact that individual acts of members of a community , by no stretch of imagination could be made basis for making derogatory remarks about the whole of the community. I absolutely disagree with the sayings of Mr. President of Ex-serviceman Society. Mr. ex-Serviceman it may be in your kind notice that hundreds of thousands of acts are being done by your own servicemen/ brethern, ex as well as serving service men on day to day basis, but it does not entail the public to condemn your brethern as the people of pakistan are fully aware of the fact that the power flows from the barrells of the guns and not from the ballotts. The latest example of the breach of trust committed by ur brethern is the demolition of the Northern Bypass bridge,Karachi. Do u think , will any body be held responsible ??? will any serviceman will take responsibility of the demolition of the bridge??? will any ex- or present serviceman sitting in a post in National Logistic Cell well be hanged for playing with the lives of innocent public????? what will be Your comment over this topic?????/ i wish if u could have the courage to write a ssingle line on the modus superndi of the serving service men as well as the ex-servicemen in pakistan! i wish if u could draw a line between the acts done by a community and acts done by the individuals of a community, i would humbly request you to concentrate your kindself on original issues being faced by the Pakistani People .it will be a pitty if a major of your calibre indulge in such like issues, U had been protecting Pakistan, it is still ur duty to protect Pakistan from creating hatred amongst the communities!

It has become a routine of lawyers to observe boycott of courts when any member of influential group of advocates want to blaikmail judges for seeking relief of his liking. Public at large is fed up with their performance. No action is taken against any lawyers if he indulges in illegal activities.Through your esteemed daily I would like to draw attection of higher authorities to take action against those lawyers who are spoiling environment in the courts for their ulterior motives. They want to promote their own interests. Their taking law into their own hands is condemnable. If they continue such illegal activities and violation of law they will loose public confidence. They should promote dignity of law and justice if they are sincere to promote justice in society. Gangly |
